On being caught red handed with paramour she killed her husband when he objected to the adulterous relationship. But our indian judiciary is such that woman will come out scot free and the other man ( her lover ) will get convicted. WHY !!!! because women is never wrong she is always VICTIM cos she committed adultery as her husband could not satisfy her lust so she was right in killing him. AND the lover man will be convicted under IPC 497 as he is committed a crime knowingly by having a relationship with such a married woman.

Anyways its the man ( husband and lover ) who paid through their lives to satisfy (if she was ) the woman who will so come out to trap another man waiting to buy her tantrums.

मुजफ्फरनगर। शहर के कोतवाली क्षेत्र के मुहल्ले लद्दावाला में मंगलवार रात एक दुकानदार का शव उसी के गोदाम में पड़ा मिला। उसकी नृशंस हत्या से लोगों में काफी आक्रोश था। मृत शहजाद की परचून की दुकान थी और दुकान के पीछे उसका गोदाम था। शहजाद का शव गोदाम में बरामद हुआ। वहां नौकर रिजवान और शहजाद का भांजा भी काम करते थे।

पुलिस को घटना की आरंभिक जांच में ऐसे सुबूत मिले हैं जिससे जाहिर होता है कि दुकानदार की हत्या उसकी पत्नी ने ही की। मृतक के भाई इस्लाम ने बताया कि मृतक की पत्नी और नौकर रिजवान के बीच अवैध संबंध थे। पुलिस के मुताबिक शहजाद को पत्नी के नाजायज संबंधों की भनक थी। वह भी नौकर को मौत की नींद सुलाना चाह रहा था। लेकिन इससे पहले ही रईसा ने नौकर के साथ मिलकर पति की हत्या कर दी।
मृतक के भांजे ने दोनों को आपत्तिजनक अवस्था में देखा था और उनके बीच हुई बातचीत भी सुन ली थी, जिसमें दोनों शाहनवाज को खत्म करने की साजिश रच रहे थे। उसी रात शहजाद का कत्ल हो गया। शहजाद की पत्नी रईसा ने पुलिस के सामने जुर्म कबूल कर लिया है। पुलिस ने मृतक के भाई और उसकी पत्नी के बयान पर हत्या का मुकदमा दर्ज कर रईसा को गिरफ्तार कर लिया है। आरोपी नौकर फरार है।

HYDERABAD: Members of All India Men's Welfare Association (AIMWA) have given a one-day boycott call of family courts on Friday, June 18, two days before the Father's Day, to protest against the family court system. The members on Wednesday alleged that family courts discriminate against fathers by separating them from having access to their biological children.

Uma Challa of AIMWA, while talking to media persons, said that family courts are forcing fathers to pay huge sums of money to support children with whom they are not allowed to meet. The family courts are encouraging false allegations of abuse to project fathers as unfit parents.

“Family courts allow mothers to disobey visitation orders without any legal repercussion.

The courts are prolonging custody and visitation matters for years, thereby driving fathers into financial and emotional bankruptcy,” she said.

The AIMWA members demanded that the family courts immediately recognise that denying access to one's own children is abuse of human rights and depriving children of the love and care of their biological fathers is abuse of basic rights of children. “We will hold protest meeting in front of the Nampally court on that day,” she said.

Men take up cudgels against prolonged court procedures

In the run-up to Father's Day, the All India Men's Welfare Association (AIMWA), Hyderabad, has called for a nationwide boycott of the family courts on Friday as a sign of protest against the poor performance of family courts in India.

The agitation — being organised by groups in Hyderabad, Lucknow, Delhi, Chennai and Bangalore — is aimed at creating awareness of what they allege is the discrimination against fathers in custody cases.

Boycotting courts

Said P. Suresh, president, National Family Harmony Society (NFHS): “We want to boycott the courts to protest against the injustice done to fathers on a regular basis. Most divorce cases are prolonged, and judgments delivered years later.”

Speaking of his own situation, Mr. Suresh said his case, which began in 2006, hasn't reached the cross examination stage even after four years.

“I'm allowed to see my child every alternate Saturday for two hours: this is not a meaningful relationship with your child,” he said.

Child custody

The AIMWA and the NFHS and other organisations across the country are also submitting a petition to amend the procedure by which child custody cases are dealt with in family courts and members will not pay maintenance till their demands are met.

When asked to elaborate, Mr. Suresh said: “We will pay all expenses — including school fees and books — but we won't pay child support as this is a monetary provision that is consistently misused.”

Fast track courts

The NFHS is demanding that fast track courts be instituted to deal with custody cases, that a separate Divisional Bench be set up in the High Courts and Supreme Court to address appeals on custody matters, that the shared parenting concept be incorporated in judgments, and counsellors appointed in all child custody matters.

Sex abuse panel must in all firms: Draft Bill

NEW DELHI: Companies that do not set up a sexual harassment complaints committee within their organization can be penalized under sweeping provisions proposed in a draft Bill to check sexual abuse at the workplace.
The Bill, cleared by the law ministry and expected to be discussed in the Cabinet by mid-July, also seeks to make false complaints of sexual harassment punishable under service rules.
In an effort to cover every working woman under the proposed law, the ministry for women and child development headed by Krishna Tirath has included the unorganized sector in the Bill.
The Bill seeks to make it mandatory for an employer to constitute an internal committee in which most members are women. If an internal committee cannot be set up or the complaint is against the employer himself, the aggrieved woman can approach a local committee set up by the government under a district officer.
If harassment is proved, a penalty will be levied keeping in view the victim’s mental suffering, income and financial status, medical expenses incurred by her and loss of career opportunity. The Bill also prohibits publication or making contents of the inquiry or the aggrieved woman’s details available.

Indian goverment does not recognise that boys/men are also (can be ) sexually harassed exploited assaulted which is evident from the fact that the proposed SEXUAL HARASSMENT AT WORKPLACE BILL ( SHWB) is HEAVILY GENDER BIASED and gives protection to only girls/women against such sexual behaviour. However in reality such kind of abberant sexual behaviour can be mainifested by both gender equally towards either gender.

But since there is neither a MENS’ WELFARE MINISTRY nor NATIONAL COMMISSION FOR MEN that can cater to addressing the problems/concern HENCE all laws that are passed, under the pressure from radical feminist, in present times are women centric and blatantly ignore the rights of men as class/clan and are resultantly destroying the INDIAN socio cultural fabric.

Driver told TV channel Nanda did 'bad things'

NEW DELHI: Moments before his death in Safdarjung Hospital on Thursday , the 41-year-old driver of industrialist Anil Nanda made some starting revelations before a television camera. Though the police have registered a murder case, it hasn't yet questioned Nanda or his associates.
"If I speak the truth, I will not live," says the driver on camera before giving details of the espionage work given to him. He also speaks about the allegedly dangerous nature of Nanda, the younger son of industrialist H P Nanda, and the "bad things" that allegedly happened at his Friends Colony residence. He claims that people are exploited there (he uses the word "soshan").


IBN 7 showed the driver in hospital bed speaking of gay sex in the house. He alleged that boys were paid by Nanda for having sex with him. He also claimed that Nanda forced his employees to have sex with him and if anyone refused, he threatened them with dire consequences. Despite repeated attempts, Anil Nanda was not available for comment.

Sudhir Sood, one of Nanda's employees said, "We are not aware about any allegations. It was an unfortunate incident. Sharma was a good worker and was working as driver of the escort vehicle of Anil Nanda. We are cooperating with the police in the investigations of the case." He further said that Nanda would not like to comment on the case and he does not deal with the employees directly.

No arrest has been made in this week-old case so far. The driver's family are alleging that the police is under pressure and are not acting against the "influential accused". Sharma's younger brother Yogesh said: "The police did not do anything. Despite our repeated requests, my brother's statement was not recorded before a magistrate. My brother had objected to the goings-on at the place where he worked. This cost him his life. He had expressed fear about his and his family's safety."

On its part, the police said that they were looking at the case from all angles. They have also received a letter from the driver's family, allegedly written by Janeshwar Sharma himself. The letter has more disturbing details, and the police is checking out its veracity. Asked about Sharma naming on camera Nanda and his two employees, Dhiraj Badani and Jitendra Pandey, the police claimed that these three were not present at the spot when petrol was poured on Sharma from behind and he was set alight. A police officer also said that Sharma had applied for a loan of Rs 3 lakh on June 3 and on June 4 Nanda had turned it down.
Additional CP (south east) Virender Singh Chahal said, "We have registered a case of murder and are investigating the matter from all possible angles."

In his statement to the police, Sharma had said that he was asked to tail a business partner of Nanda's, Vijay Sinha. However, he was caught by Sinha and scolded. He was asked to confess on whose behalf he was tailing Sinha. The FIR says that to a question asked by the police, Sharma replies: "It is a long story and I cannot reveal it now." Sharma also added that he didn't see his attacker. The man came from behind, poured petrol on him and set him on fire. This happened at Nanda's bungalow at Friends Colony (west). While the police is being discreet as it carries out its investigation, an officer said that if the letter written by Sharma turns out to be authentic, the case could take a dramatic turn.

Father’s Day: Spare a thought to those suffering from legal battles over child custody

As usual, the doctor appeared quite confident of his success. And why wouldn’t he? One of the perks that came with a professional life that boasted of successfully handling thousands of such ‘critical’ cases over the last 10 years or more was confidence. Only the place and predicament were different this time. Standing firmly in the witness box, he was used to the public gaze that never unnerved him. But there was somebody sitting in the front row of the room, constantly staring at the him; quite discomforting for him. Finally, the judge delivers the verdict. The doctor has lost the case. Standing stunned for a few minutes, he suddenly turns into a picture of contrast.

Confidence gave way to anxiety; hands, which were always firm in wielding the scalpel, started trembling; eyes, which had never exhibited emotions, became moist. He collapses and breaks down in tears.
The ‘somebody’ sitting in the front row seat was his daughter. Dr Anand Parekh had not met Shruti for a year, and had been fighting for her custody since last six years.

Now, he has lost all—his daughter as well as interest in life. While the world will celebrate Father’s Day this Sunday, for many like Dr Parekh it will be a day to mourn. “What’s the point in being a father when you are deprived of your child,” said a devastated Dr Parekh. “Just because I didn’t give birth to her, doesn’t mean I can’t bring her up properly. A father can also be a mother.”
Fast-food culture, fast-paced life and fast disintegrating families — India has seen all in the last decade or so. The only two things that have not changed perhaps are the excruciatingly slow pace of justice, and a notion that man can’t play the role of a mother.
“It’s an old notion and goes back to the time when women didn’t have a professional life and took care of the family,” said S Susheela, a Bangalore-based advocate practising in the Karnataka High Court.
“So, it was thought that she could bring up the children in a more proper manner and spend more quality time with them. But now such a notion no longer holds true.” These days both the parents are working and can equally bring up the child, she adds. “For a child, both the parents are equally important and his/her isolation from either of them should be condemned.”
Most of the child custody battles in the country, unfortunately, have become a man versus woman fight, a fight in which the child is used as a pawn.

“We had a divorce by mutual consent and it was decided that my five-year-old son would stay with me. But after seven months, my wife files a case in the court saying that she is the natural guardian and court grants her permission to take away my son,” says Sunil Dabas, who works as a manager in one of the MNC banks in New Delhi.
“I used to bathe my little son, prepare his school lunch box, drop him to the school and play cricket with him every evening. And one fine day I am told that I can’t bring up my child properly because that can be done in a better way by a woman!,” says Sunil with a choked voice.

CRISP (Children’s rights initiative for shared parenting), a Bangalore-based NGO formed by parents, mostly fathers, fighting for the custody of their children, has been advocating the need for speedy justice and shared parenting. “My daughter was studying in 1st standard when I got separated from her.
Now she is in 10th and I am still fighting for her,” says Kumar V. Jahgirdar, founder of CRISP, who has been engaged in a legal battle with her former wife since 1999. “Can I get back those golden 10 years of my daughter’s life when she was growing up,” asks an aggrieved Kumar who still feels that he would get justice.

The tardy legal system has in fact turned India into a hot destination for NRI parents, especially mothers, escaping with their children as they know that Indian judicial system will take too long in deciding the case.
“There has been a dramatic jump in the number of such NRI cases,” says PBA Srinivasan, a New Delhi-based advocate practicing in the Supreme Court. “And the motive in most of such cases is either extracting money from the estranged partner or settling an ego battle.”

While the NRIs may be taking advantage of the legal system, millions in India have lost hope in the judiciary. “Lucky are those who are embedded in closely-bonded communities with well functioning and responsible biradari/jati (lineage/caste) panchayats because they do not need to depend on sarkari (state) courts to resolve their marital disputes and the future of their children,” said Madhu Kishwar, a human rights activist and professor at Centre for the Study of Developing Societies.

“If our judicial system can’t give justice to the Bhopal victims, do you think it can handle in a sensitive manner the fates of traumatised children who are at the centre of custody battles?”
Indeed, custody battles are not only about the hapless fathers who are deprived of the love and affection of their children and are at the receiving end of the judicial system.

It’s also about another silent victim — the child. In the US, it has been found after extensive scientific research that children from broken families without a father are: 14 times more likely to commit rape; 5 times more likely to commit suicide; 20 times more likely to end up in prison; 10 times more likely to take drugs; 32 times more likely to run away from home; 20 times more likely to have behavioral disorders; 9 times more likely to drop out of school; 9 times more likely to end up in a state operated institution.
However, in India no such studies have been conducted but the results of a fatherless society could be devastating. “Father is the epitome of security, authority and support,” says Dr Jayanti Dutta, a consultant clinical psychologist.

“And if the father is not there, for whatever reason, that sense of security is gone. A mother may take on paternal role along with the other roles that she is playing simultaneously. But there is likely to be a role conflict,” adds Dr Dutta. “Just by wearing a western outfit, a woman doesn’t become a man.”
Sandhya Bajaj, member, National Commission for Protection of Child Rights (NCPCR), says: “It’s ultimately the child who is the loser. As long as parents play dirty games against each other and use the child as a pawn to settle scores, no solution could be found.”

At the end of the day, it’s the children who pay the biggest price for the irresponsibility of their parents. “Very few people ask themselves whether they are really fit to be parents. They end up producing children simply because they are biologically capable and it is a thing to be done,” says Ms Kishwar.

“One should avoid producing children if one can’t provide them a stable secure family life.” A thought for the day, come Sunday

New Delhi, Jun 18: Delhi High Court dismissed a Public Interest Litigation (PIL) seeking amendment in the law to ban marriages in the same clan (gotra). Delhi HC called the petition as 'a waste of time', prompting the petitioner, Naresh Kadyan, to withdraw his plea. The vacation bench of Justice SN Dhingra and Justice AK Pathak took the decision.

"You don't know what gotra is. Which Hindu text prescribes banning of sagotra (same clan) marriage? Why are you wasting the time of the court," the court asked.

"If you are not able to substantiate your words, then you should not have come before the court," the bench said.
Kadyan's counsel Rajendra Yadav sought the direction of the court to the government for the recruitment of a commission to bring about the necessary amendments in the Hindu Marriage Act to ban same gotra marriage. The councel submitted by Kadyan representing Khap Panchayats submitted that same gotra marriage is violative of the fundamental rights and against the Hindu traditions

Respected JUSTICE S N DHINGRA ji I bow down with true respect and salute your courage and honesty to highlight what the indian judiciary and judicial system should do to uphold the duty given by the constitution to render REAL JUSTICE to the culprits and save the innocent indian citizenary from the evil clutches of the culprits, real perpetrators,abettors of the crime and abusers of the police/judicial powers.

“Honour killings” in recent past were hyped by media to be the diktats of the KHAP PANCHYATS and these khap panchayats were labelled variously such as talibanian, were demoralised, ridiculed and banished without giving a deeper thoughts to the real cause of mishaps. However the main culprits majorly are the parents of the girl and police who penalise and extort boy/husband family for their vested interests and yet go scot free.

Parallely this incident once again shows the way indian police works – It saves the CRIMINALS by implicating INNOCENT citizens into false and fabricated cases and thereby converting them into CRIMINALS.

Additionally for few more bucks the same police indulges in the same process in 498a (DOWRY HARASSMENT) cases also where the police yet again connives with the girl and her parents, overlooks the laws and guidelines laid down and without doing any investigation falsely implicates the innocent husband’s and his family.

If u look closely most of the crime against girl and women happen at her natal homes of the girl but it is the husband (or would be husband) and his family who bears the brunt for no fault of his.

New Delhi The Delhi High Court on Thursday slammed the police for its failure to protect couples from honour killings in the national capital, saying that they "connive" with the families for money.

"You can search the entire city if a dog of your boss is lost but you can't provide protection to the people. This is what you are. What to talk about humanity when you don't have shame," the court said.

The observation was made in an apparent reference to an incident involving a Delhi police Commissioner's dog which had gone missing on March 30, 2008 and police personnel made massive hunt to trace the 12-year-old canine.

Vacation judge Justice S N Dhingra also came down heavily on the police also for converting matters relating to girl's elopement into rape cases to send the boy behind the bars.

"Its unfortunate that elopement cases are converted into rape cases. Your police is party in all cases of honour killings. You connive with parents and turn your face the other side. You send boys behind bars on rape charges and allow the parents to kill their daughter," the court said.

"How can you be so insensitive for a few bucks. In case of elopement, you register the case under section 376 (rape) of Indian Penal Code. You do not register case or take action where you should have done," Justice Dhingra said.

The very manner in which the police sent the men for marrying their loved ones to jails also came in for sharp criticism by the court which said "you are turning normal citizens to criminals".

The court passed the observation when Delhi High Court Legal Services Aid Authority pointed out a recent case in which a man was sent to jail for eloping with a girl on a complaint by her parents alleging she has been raped.

Kiran Singh, the advocate, appearing for the Authority, said that the condition of the girl who is pregnant is pathetic as her parents had deserted her and the youth she wants to marry is in jail.

Singh also informed the court that the girl is required to be protected as she is fearful of being killed by her parents if they come to know about the pregnancy.

The Court after hearing the arguments pulled up the police for its role in the case and directed it to produce the youth before it to decide the fate of the couple.

Background events leading to the couple appearing in courts

Fearing honour killing, a couple who married without the consent of their families Thursday approached the Delhi High Court which granted them protection.

Vacation bench of Justice S.N. Dhingra directed Delhi Police to give protection to the city-based couple, who belong to Aligarh.

Anuj Chauhan and Gunjan, who belong to different castes got married May 3 at a temple here in east Delhi's New Ashok Nagar.

The couple were receiving constant threats from the girl's family, the petition said.

The petition said they wrote letters to the Uttar Pradesh government and state police but no action was taken on their complaint. They then decided to approach the court.

The court issued notice to Gunjan's parents and also to director general of police, Uttar Pradesh, and senior superintendent of police, Aligarh, and asked them to file their responses by July 14.

The court directed Delhi Police to depute a constable to visit the couple's home daily and submit a report by the next date of hearing.
